AIRCRAFT ENTRY REQUIREMENTS
Aircraft of signatory states of the Convention on International Civil Aviation intending to overfly, make a private flight in or make a stop for nontraffic purposes in Thailand, or for taking on and/or discharging passengers, must apply in writing or via telex or AFTN message to the Department of Aviation, Ministry of Transport and Communications, Soi Ngarmdu-Plee, Tung Mahamek, Bangkok, Thailand
(AFTN: VTBAYAYD, TELEX: 72099 DEPAVIA TH, FAX: 66-2-287-3139).
1. NONSCHEDULED FLIGHTS - Subject to the observance of the terms of the convention on International Civil Aviation, application must be made and prior approval obtained from the Thai Department of Aviation for all aircraft of the Contracting States of the Convention desiring to carry out nonscheduled flight into, in transit nonstop across Thailand, or to make stops for nontraffic purpose in Thailand.
2. The application must contain the following particulars:
a. Name, address and business connection with the aircraft of the informant;
b. Owner, type, nationality and registration of the aircraft;
c. Name of operator;
d. Purpose of flight;
e. Routing, including aerodromes before/after Thailand;
f. Names of aerodromes in Thailand where landing is required; and
g. Dates and times of its arrival and departure at each aerodrome.
3. Aircraft of noncontracting States of the Convention on International Civil Aviation, desiring to fly in transit, nonstop across Thailand or to land for nontraffic purposes, must apply and obtain prior approval through diplomatic channel. The application must contain the particulars in 2 (two) above.
4. Aircraft of Contracting States of the Convention on International Civil Aviation, intending to perform a nonscheduled flight flight into and/or out of Thailand for the purpose of taking on and/or discharging passengers, cargo and mail, must apply in writing to the Department of Aviation.
5. The application must be submitted not less than 7 days in advance of the intended date of operation and contain the following particulars:
a. Name, address and business connection with the aircraft of the applicant;
b. Owner, type, nationality and registration mark of the aircraft;
c. Name of operator;
d. Purpose of flight and landing in Thailand;
e. Routing; and
f. Names of aerodromes in Thailand where landing is required.
4. PRIVATE FLIGHTS - Procedures: Aircraft of the Contracting States of the Convention on International Civil Aviation intending to perform private flight into, in transit, nonstop across, or to make stop for nontraffic purposes in Thailand, or for taking on/and discharging passengers must apply in writing or TELEX or AFTN message to the Department of Aviation. The application for small aircraft with maximum take-off weight not exceeding
5700 kilograms and for helicopter must be submitted not less than 15 days in advance of the intended date of operation and contain the following particulars:
a. Number and type of aircraft;
b. Identification/nationality and registration mark of the aircraft;
c. Flight rule and status;
d. Route schedule;
e. Date/times of entry/exit BKK FIR boundaries;
f. Date/times of arrival/departure (in case of landing in Thailand);
g. Airways to be used via BKK FIR:
h. Alternate aerodrome;
i. Speed;
j. Level;
k. Endurance;
l. Passengers on board;
m. Crew;
n. Purpose of landing;
o. Purpose of flight; and
p. Owner and address.
6. PRIVATE AIRCRAFT with a maximum take-off weight exceeding 5700 kilograms, application procedure prescribed in Aircraft Entry Requirements shall be imposed thereof.
7. AFFINITY GROUP CHARTER FLIGHT
a. The entire capacity of the aircraft shall be hired by a club or an association. In specific cases, however, exemption may be granted, permitting up to three charterers for one flight.
b. The club or association shall be of a permanent character (juristic person) and its principle purposes shall be other than travel arrangements and the membership of the club or association must not exceed a maximum of 20,000.
c. The persons who are to be transported, shall be members of the club or association for not less than
six months. Qualified to participate are likewise parents, spouse or children of such a member, provided that they belong to his household and are accompanied by him.
8. INCLUSIVE TOUR CHARTER FLIGHT
a. The entire capacity of the aircraft shall be hired by one or several persons in charge of Inclusive Tour Charter Flight and shall be reserved for the sole use of the participants of a travel program which has been fixed in advance. If the trip is to be retarded as an inclusive tour, the following conditions must be complied with:
1) The duration of the tour shall not be less than one week.
2) The travel arrangement shall comprise transportation, hotel accommodation and meal (i.e., at least breakfast and one principal meal) as well as excursions, if such arranged and including home transportation.
3) Each group of passengers to be transported shall consist of not less than 15 persons, all from the same Inclusive Tour Charter Agency and with the same travel arrangement. The same aircraft may carry several of these groups.
4) There shall be a travel agency courier at the disposal of the group at the point of destination.
5) The participating group members shall make full payment, no refund of payment in case of the arrangement not being utilized, for the entire travel arrangement.
b. Transportation of revenue passengers who do not participate in the Inclusive Tour Group, is not permitted.
c. The flight may not be performed with aircraft not owned by the contracting charter company, unless special permission has been obtained from the Department of Aviation.
d. Any amendments in the flight programme on which the permission of the Department of
Aviation is based, shall be submitted for approval.
e. It is the duty of the charter company concerned to control the participants of the respective groups to be all transported together on the outward and return flight. Any deviation, as well as the course thereof, shall, at the soonest, be reported to the Department of Aviation upon the return of the aircraft to the point of origin.
9. OWN CHARTER FLIGHT
a. The entire capacity of the aircraft hired by the charterer (individual, firm, legitimate club or associations) for transportation either of employees of the charterer or of persons affiliated with the charterer other than employees (e.g., the hiring by a sports cub for transportation of a football team to a match).
b. The charterer of the aircraft, solely, shall decide the destination of the aircraft as well as arrangement connected with the journey.
c. The charterer shall defray all expenses incidental to the flight, no payment, either direct or indirect, to be made by the participant of the flight to the charterer.
CORPORATE AIRCRAFT CONTRAINTS
Corporate operators must apply to Director General, Department of Aviation, who will ``approve internal flights on a case-by-case basis taking into account the availability and capacity of Thai air taxi operators''.
